Overview

Digigainz is a content monetization technology that lets website owners (referred to as “Publishers”) who run blogs, deal websites, coupon websites, forums, or other similar websites monetise links that they share or publish on their websites. After reading the blogs, bargains, and other content, visitors or users click on the links provided by the publisher, which takes them to websites that are shared by the publisher and offer the same deal, product, or service (referred to as “Merchant Websites”). If a user purchases something on any of these Merchant Websites, the Publisher receives a commission from Digigainz equal to a certain proportion, depending on the terms of their business arrangement. By publishing and disseminating links to these merchant websites, it is a technological platform that promotes affiliate marketing for the benefit of individuals who write about and share their opinions and experiences with different online merchants.

How are Digigainz used?

The Code and a comprehensive installation and usage guide will be sent to the Publisher by Digigainz following the Publisher’s successful registration. Without needing to apply to each merchant directly, publishers are instantly connected to all of the Digigainz-associated merchants. Publishers have access to a dashboard through their Digigainz account that offers comprehensive information regarding Merchant links that have received the most clicks, individual revenue earnings (EPC, conversion rate) from each Merchant, payout data, and more.

In order to use Digigainz’ service, the Publisher must make sure that the links and information on their publication website are legitimate and not fraudulent or deceptive. Please see the Section under “Responsibility of Publishers” in this Terms of Use agreement for specifics on the Dos and Donts that the Publisher must abide by.

Services Provided

Digigainz offers its registered Publishers a technological platform that facilitates direct communication with Merchants and aids in the easy, effective, and efficient monetization of the material they post on their Publication websites (referred to as “the Service”). The Terms of Use, which Digigainz may alter from time to time, shall govern the use of the Services. Please check the “Terms of Use” page on our website again to be informed of any updates we may make. To utilize the Services that we provide, you have to be at least eighteen years old. It is totally forbidden for anybody under the age of 18 to register on our website, use our mobile application, or do any other action that might give the impression that you are 18 years of age or older. If you are the parent or legal guardian of a child under the age of 18, you hereby provide permission for your kid to register on our website and you accept responsibility for your child’s use of it, as well as the terms and conditions of this “Terms of Use.” You consent to abide by the Terms of Use stated here by using the Services in any way.

In addition to these Terms of Use, there may be additional terms and conditions on some parts or pages of this website. We advise you to carefully read those extra terms and conditions. You acknowledge and agree to be bound by such extra terms and conditions by using such areas or sites. If there is a dispute, your use of those particular areas or pages will be governed by those extra terms and conditions. In this regard, Digigainz offers the following services to its Publishers:

  1. With a Digigainz account, publishers may see a comprehensive dashboard panel of all Digigainz-affiliated merchants and are connected to them directly, saving them the trouble of applying to each merchant separately.
  2. Publishers may choose not to be associated with a specific Merchant by contacting Digigainz via email using the email address they have on file. Digigainz gives Publishers an easy-to-install Code that turns any Merchant links they post on their Publication website into affiliate links.
  3. Publishers may also choose to use other affiliate links that are unrelated to Digigainz; in this scenario, even if the Java code is loaded on their machine, the link they submit will not become a Digigainz Merchant Link.
  4. If customers make more than one purchase from a merchant’s website, publishers won’t have to get in touch with several merchants or affiliate networks to get confirmation, a record of the transaction, or a commission payment. Digigainz is responsible for overseeing the Publisher’s account and maintaining a current log of real purchases made on the Publisher’s website. Digigainz transfers the commission that arises on an actual basis from the purchases you make on the Merchant Websites directly to your account or sends you a check for that amount.
  5. Merchants often make changes to their websites, which can simply reroute the Publisher to a malfunctioning page or render the affiliate links that are already in place nonexistent. For its Publishers, Digigainz monitors and administers current links. By connecting with the Digigainz HTTP API made available to its Publishers, the Publisher can modify its website re-direction script in place of installing the Code that is supplied upon successful registration. This will reroute URLs that you share through the Digigainz server, and Digigainz will handle the monetization.

 

The Publisher shall adhere to the terms and conditions of this Terms of Use agreement, which may be changed from time to time by Digigainz, in order for the Publisher to provide the aforementioned services (hereinafter referred to as the “Service”). If we make any significant changes, we will send you an email to let you know about them. To keep informed of any changes we may make, we do recommend that you routinely review the “Terms of Use” page on our website. Not knowing about the modification won’t be a justification for breaking the revised Terms of Use.

Permit

INTELLECTUAL RELATIVES

Digigainz’s Intellectual Property Rights (hereinafter referred to as “Intellectual Property”) comprise all of the company’s proprietary and intellectual property rights, including rights over its data, information, techniques, methodologies, and materials; computer programs; javascript code software; source code of the Digigainz program; and object code. Additionally, Intellectual Property Rights shall include all rights appropriately associated with copyright (including rights in audiovisual works), trademarks (including logos, slogans, domain names, trade names, and service marks); patents (including patent applications and disclosures); designs; and proprietary rights and trade secret rights, recognized in any nation or jurisdiction on earth.

It must not be allowed for the Publishers to, either directly or indirectly:

 

  • distribute, transfer, assign, lease, resell, recirculate, rent, lend, transmit, sell, recirculate, publish, or make accessible in any other way all or any portion of the intellectual property;
  • Copied, translated, converted, decompiled, altered, enhanced, disassembled, modified, altered, or developed further the source code included in the Digigainz software or the Code;
  • Reverse engineer, reverse assemble, reverse compile, or translate the Code in any other way;

 

  • Disrupt the Service’s operation or make any other effort to find the source code found in the Code or in the Digigainz applications;

 

  • Utilize the Code (or any of them), our programs, or any of them illegally or in a way that is against the terms of this Agreement.
  • violate the intellectual property in whole or in part, or seek to violate it in any way;
  • Use the Service in any manner other than those that are specifically specified here; Digigainz shall always be regarded as the owner of all rights, titles, and interests in the Intellectual Property, as well as all improvements, developments, and derivative works of it and the intellectual property rights embodied therein.

 

  • With the exception of the restricted license that is specifically given here, you will have no rights with regard to the aforementioned.

 

The intellectual property laws of India or another nation may offer protection to the merchants connected to Digigainz. If you attempt to alter, reproduce, distribute, transmit, resell, redistribute, broadcast, display, perform, reproduce, publish, license, frame, transfer, or use in any other way, in whole or in part, any intellectual property that belongs to these merchants or is related to their goods and services, you risk violating their policies, which they may enforce both inside and outside of India. Digigainzis does not and will not be obligated to bear any repercussions from the Publisher’s infringement of or attempt to infringement of such Merchants’ intellectual property. By signing this agreement, you accept full responsibility for any claims or disputes that may emerge from Merchants claiming that Digigainz has violated their intellectual property.

This agreement between the Publisher and Digigainz and all claimants under Digigainz (“Indemnified Persons”) absolves the Publisher of all liability for losses and/or damages resulting from notices, proceedings, litigations, claims, penalties, demands, causes of action, judgments, liabilities, costs and expenses (including reasonable attorneys’ fees) that may arise out of, in whole or in part from:

  1. Publisher’s direct or indirect violation of this clause’s duties and terms; infringement of the intellectual property rights of merchants connected to Digigainz, or attempt to infringe upon such rights; merchants’ claims that Digigainz has violated their intellectual property. Applications for mobile devices

 

For your knowledge, we may add that Digigainz is currently creating a special mobile application for smartphones and other communication devices called the “Digigainz App” in an effort to improve the overall experience of our clients. You may easily access your Digigainz account and any other Merchant data you need with the help of this application. You will be able to install the JavaScript code on your mobile devices through this mechanism, and the Digigainz App will function similarly to the one you access on your computer, laptop, or tablet in terms of converting merchant links into affiliate links, keeping track of commissions receivable and other payouts, etc.

In this regard, Digigainz disclaims all responsibility for any loss, injury, damage, or harm you could experience, whether directly or indirectly, as a result of:

damage to your smartphone or any other communication device brought on by downloading any malicious or tainted viruses or the material that goes with them; OR

Purchasing goods or services through the download of a mobile application Refund requests submitted on Digigainz for fees incurred in connection with these premium mobile apps

Publishers’ accountability

We recognize the freedom of expression and ideas that people attempt to express through websites, blogs, and other online platforms. Having said that, you recognize and appreciate your moral obligation with regard to the information you publish on your publication website, especially in light of your affiliation with Digigainz and the affiliate merchants that have registered with Digigainz.

  • By using the shared links, you thus consent to not publish or otherwise make any content available:
  • without Digigainz’s prior written consent, make or try to initiate unsolicited contact with any of the Merchants for any reason.
  • gather personal information about any of the Digigainz network’s merchants, or “stalk” or otherwise harass any such merchants;

 

  • utilize automatic methods to download data from the Service, such as robots, spiders, crawlers, data mining tools, or the like, unless Digigainz has given permission in writing;
  • try to access Digigainz’s servers or computer systems without authorization, or take part in any activity that degrades, interferes with, or disrupts the functioning of our website or the service in any way.
  • delete or alter any content on the Digigainz domain, try to get around security, or obstruct the Digigainz domain’s or any servers hosting it from operating properly;
  • abuse any other information or content found on the Digigainz website, including the login credentials;

 

  • interfere with any other party’s use and enjoyment of any Digigainz website or service, or harm, disable, overload, or impair the Digigainz website or service.

 

  • obtain unauthorized access via hacking, password mining, or any other method to any computer systems or networks linked to any Digigainz website or service.
  • connect to our website from any other website without getting our permission in writing first;
  • frame or copy the Digigainz website’s home page, which contains content that violates the company’s intellectual property rights or the rights of third parties, or that is illegal, threatening, abusive, libelous, pornographic, obscene, vulgar, indecent, or objectionable;
  • abuse, duplicate, or copy the computer program’s source and object codes found on the Digigainz website;

 

  • otherwise carry out any action that is not specifically allowed by the rules of this “Terms of Use” agreement.

All issues pertaining to the functionality, upkeep, and content of your publication website, including but not restricted to:

  • Composing and publishing links and merchant descriptions for your publication
  • Legitimacy and genuineness of the opinions, experiences, and ideas offered in relation to the Merchants’ goods and/or services;
  • The suitability and correctness of all content published on your publication, including—but not limited to—any details about merchants and the goods and/or services they offer
  • Any purchases made by visitors using links you’ve provided, or any loss, injury, or damage resulting from such purchases or actions taken as a result of advice or ideas found on the Publication website;

 

  • Inconvenience that any broken links on your publication website may have caused to your visitors or potential customers. Additionally, you represent and guarantee that you will abide by all laws, rules, and policies that are relevant to how you operate and use our service, including, but not limited to, those that require disclosure of a significant relationship that is inherent in the links on your Publication website.

 

The Publisher hereby agrees to fully indemnify, save, defend, and hold harmless Digigainz and any claimants under Digigainz (collectively, “Indemnified Persons”) against any losses and/or damages resulting from notices, proceedings, litigations, claims, penalties, demands, causes of action, judgments, liabilities, costs and expenses (including reasonable attorneys’ fees), that may be alleged to result from the Publisher’s breach of the terms and conditions set forth in this clause, either directly or indirectly.

System Faults
You could occasionally have trouble reaching Digigainz using the internet or another electronic or wireless device, or accessing the Digigainz website due to excessive internet traffic, transmission issues, system capacity constraints, and other issues. Any computer system, electronic device, or mobile device used to access the Digigainz Website may encounter unexpected disruptions, slowdowns, or capacity issues. Your ability to utilize our website continuously and satisfactorily will be largely dependent on your internet service provider, your computer’s or laptop’s continuous internet connection, and your data network or Wi-Fi connection. Digigainz disclaims any warranties on uninterrupted, safe, or continuous website access. Therefore, in order to guarantee continuous usage and access to your Digigainz account on our website, we suggest you to verify and set up the necessary internet and wireless connections.

Digigainz disclaims all liability for any loss or harm to the Publisher resulting from Website lag, unplanned crashes, bugs, or other system or technical malfunctions.

Indemnification:

 

This agreement between the Publisher and Digigainz and all claimants under Digigainz (“Indemnified Persons”) absolves the Publisher of all liability for losses and/or damages resulting from notices, proceedings, litigations, claims, penalties, demands, causes of action, judgments, liabilities, costs and expenses (including reasonable attorneys’ fees) that may arise out of, in whole or in part from:

  1. Failure, for whatever reason, on the part of the Publisher to install the Javascript Code that was sent to them upon registration;
  2. Digigainz’ access to the Publisher’s Website allows it to replace links that the Publisher has shared.
  3. damage of any kind inflicted upon the Publisher’s computer system as a result of downloading or installing the Code or any other content from our website, including loss of data or system slowdown;
  4. providing or revealing its API key or login credentials to third parties;
  5. loss or damage to the Publisher resulting from unplanned crashes, slowdowns, or other similar technical or system faults on the Website.
  6. purchases made by users using affiliate links that weren’t the Publisher’s Digigainz;
  7. Any claims by third parties resulting from Publisher’s use of our service in a way that isn’t compliant with the terms and conditions of this agreement; Publisher’s failure to fulfill any of its duties under these terms and conditions.

Unexpected Events

 

Digigainz disclaims all liability for any loss or damage arising from delays or interruptions caused by mechanical or electrical equipment failures, phone line issues, weather-related issues, strikes, walkouts, fire, acts of God, riots, armed conflicts, acts of war, or similar circumstances. Digigainz disclaims all liability for granting you access to our website during these unplanned pauses or delays.

Duration and Ending

 

This Agreement will start as soon as Digigainz properly approves the Publisher’s Digigainz application and last until either Digigainz or the Publisher terminates it, giving the other party at least seven (seven) working days’ notice. Digigainz shall pay you the remaining commission owed for referrals that result in actual purchases made through your Publication website in the event that this Agreement is terminated for any reason other than the Publisher’s violation of its terms and conditions. Regardless of your termination, you will get this money according to the Net60 payment cycle, which is two months after Digigainz has paid the Publisher’s commission. Digigainz will determine the Publisher’s compensation amount at its sole discretion after taking into account the referrals that result in actual transactions and the commission Digigainz has earned from the Merchants.

In the event that this Agreement is terminated for any reason, you will have to stop using our service right once and remove and erase from your publication website any references to it as well as any other material pertaining to our intellectual property that may be relevant to your line of work.
